South Carolina Passes Landmark 'Right to Race' Legislation

South Carolina has become the fourth state to enact Right to Race legislation after Gov. Henry McMaster signed House Bill 4706 into law on May 19, reflecting growing national momentum to preserve motorsports facilities as suburban expansion continues to impact racetracks across the country.

The new South Carolina Right to Race law is designed to protect existing racetracks from nuisance lawsuits tied to nearby residential development, providing long-term protection for motorsports venues that often face legal challenges as housing developments expand closer to established racetracks.

Supporters of the legislation argue that it reflects a growing national consensus on preserving motorsports facilities, with the American Motorcyclist Association, Specialty Equipment Market Association, and Performance Racing Industry backing the bill alongside Governor McMaster's signature.

The passage of H. 4706 is another welcome addition to the growing support behind Right to Race legislation across the country, according to Max Colchin, AMA eastern states representative, who praises Governor McMaster for his role in signing the law and South Carolina lawmakers for their commitment to protecting the state's racetracks.

Under the new law, pre-existing racing facilities in South Carolina cannot face nuisance claims from surrounding property owners within a three-mile radius, provided the racetrack secured the necessary permits or existed before nearby landowners purchased or developed their property.

The law provides significant economic benefits to South Carolina, with the AMA stating that the racing industry contributes nearly $1 billion annually to the state's economy and supports more than 5,000 full-time jobs statewide.

South Carolina joins Iowa, North Carolina, and Kansas as states that have adopted Right to Race legislation, with similar bills currently active in Michigan, Ohio, and Oklahoma as lawmakers and motorsports advocates continue pushing for racetrack protections nationwide.

The passage of this legislation marks a significant shift in the national conversation around motorsports facility preservation, highlighting the need for policymakers to balance economic development with community concerns.

As the motorsports industry continues to evolve and expand, it's essential that policymakers prioritize the protection of existing facilities to ensure their long-term viability and contribution to local economies.

The Right to Race legislation is a crucial step towards preserving America's racing heritage and ensuring that future generations can enjoy the thrill of motorsports at iconic tracks across the country.
